Is CBD legal in Arizona?

Yes, CBD oil is legal to buy and sell in Arizona. CBD oil derived from hemp doesn’t even require a prescription or medical marijuana card – it is even being sold at gas stations.  More about why you need to know your CBD source here.

Hemp Legalization in Arizona. In 2014, President Barack Obama signed The Farm Bill of 2014, which legalized the research and cultivation of industrial hemp at the federal level. At this time, interest in hemp began to grow as more and more research began to appear, revealing the many uses and benefits of this non-psychoactive form of the cannabis plant. However, the law still allowed for state and local governments to impose their own restrictions on the use of hemp.

In May 2018, when Governor Doug Ducey signed SB 1098, that the cultivation and usage of industrial hemp became legal in Arizona. The Arizona Department of Agriculture requires anyone growing, transporting, harvesting, or processing hemp is required to obtain a license.

Products derived from hemp, including CBD oil, are legal in Arizona as long as the CBD is derived from legally harvested hemp containing no more than 0.3% THC, and that it comes from the mature stalks, oil, stalk fiber, or sterilized seeds of the hemp plant.

Why it is most important to know your CBD Source!

CBD is derived from the industrial hemp plant.  Hemp is a bio-accumulator.  Meaning that they absorb contaminants in the soil and air faster than they excrete them.“Literally the plants suck out the toxins into the structure of the plant because of the way the hemp is formed,” Rowlands told Hemp Industry Daily.  Great for bio-remediation, which hemp is utilized for, but not good if being harvested for CBD products.  

As hemp is grown all over the world, in various geographical areas a large disparity of quality products can be assumed.  China is the leading grower with a market share of 70% followed by France and than the USA.  Not all farms are located in pristine growing regions and not all farms grow organically or even sustainably for hemp derived CBD.  Many CBD products are not labeled with origin.  As of date, there are no labeling laws and many CBD products being sold here in the USA originate from farms in other countries that are heavily polluted and/or do not have the stringent growing regulations and certification of the USA.  Within the USA we have our own toxic environments, such as old tobacco farms, that used pesticides, being converted to hemp production.  What about fracking/oil production alongside hemp fields?

With the overwhelming number of CBD purveyors online (2,600 brands!) and now available in every grocery chain, corner convenience store and gas station choosing CBD products can feel a bit overwhelming.  The easiest way to find a high quality CBD product is to look for a speciality CBD store near you.  3rd party lab tests should be available to prove what is in each products batch.  They should know their products and be able to make helpful recommendations.  
We recommend looking for CBD oils that are​ clearly labeled products with: 
  • origin, certified through state department of agriculture. Ours is certified by Colorado State.
  • actual milligrams of CBD in bottle.
  • declare <.3% THC in contents for legal purposes.
  • non gmo, and organic.
  • 3rd party lab tested.
  • type of CBD; Whole Plant, Full Spectrum, Distillate/Broad Spectrum, Isolate or Blend.
  • contain a batch/lot number for traceability.
  • List all other ingredients which should be only premium organic carrier oils, (hemp seed oil, MCT coconut oil and olive) and other ingredients.

CBD oil is legal to buy and sell in Arizona and one is starting to see it everywhere.  So where and how do I buy CBD oil in Arizona.  Well of course some places such as gas stations and convenience stores should be avoided like the plaque.  Look for a specialty store, as they will be specializing in Hemp and should have the time and knowledge to allow for an educated purchase.  As supplements are not required by the government to meet any regulations, one must be sure the CBD oil they purchase is safe, legal, and free of harmful ingredients.   Hemp is a bio-accumulator, meaning it absorbs toxins from the environment, air, water, soil and anything we add to the grow.  You want to be supplementing with something that is  helping you, and not adding more toxins that may cause damage.  That is why it is so important to know your supplier and their source.  They will have done all the research for you and if they can't answer your questions, you should consider purchasing elsewhere.  Some questions to ask of your supplier are:

  6. Product labeled with CBD in milligrams, type of CBD, Full Spectrum, Broad Spectrum Distillate, Isolate or Blend, country of origin, batch number for traceability back to lab tests/certification.
  7. Does it contain other ingredients?  What and Why?  Are they organic, non gmo?

CBD for childhood autism

One study this year looked at cannabis as a potential treatment for Autism Spectrum Disorder (ASD) and for the first time produced clinical data showing clear benefits in pediatric cases.
The study, published in the journal Frontiers in Pharmacology, included 53 patients with a median age of 11 years old, and attempted to gauge improvement across a varied set of symptoms related to ASD after administering a daily dose of CBD. 
Patients showed significant improvement in hyperactivity symptoms (68.4%), self-injury and rage attacks (67.6%), sleep problems (71.4%), and anxiety (47.1%)—with 74.5% reporting overall improvement and less than 4% reporting worsening of symptoms.
